This Privacy Policy explains how Digital Culture Group, LLC (“DCG,” “Company,” “We,” “Us” or “Our”) collects, uses, shares and protects personal information when You visit our Website, contact Us, use our platforms (including ARI, our audience intelligence platform), or encounter advertising that We help deliver on behalf of our clients (together, the “Services”). It also explains the privacy rights You may have and how to exercise them, including how to opt out of targeted advertising.

In doing so, We build audience segments and curated advertising deals that are made available through advertising platforms such as supply-side platforms (SSPs), ad exchanges and demand-side platforms (DSPs).

To plan, deliver and measure advertising for our clients, We may process the following types of information, which is generally pseudonymous (it does not directly identify You by name):

  • Advertising Identifiers, IP address, and device and browser information

  • Information about the websites, apps, content and ads a browser or device has viewed or interacted with

  • Advertising and data partners, such as SSPs, ad exchanges, DSPs, measurement and verification partners, and third-party data providers

  • Publicly available sources

E. Sensitive information

We do not knowingly use sensitive personal information (such as health information, precise geolocation, racial or ethnic origin, religious beliefs, sexual orientation, government ID numbers or financial account information) to build audience segments or to target advertising, and We do not knowingly create audience segments based on such information. Where any campaign relies on location data supplied by a partner, We require that partner to represent that it obtained any consent required by law.

  • Necessary cookies that keep the Website working and secure

  • Functionality cookies that remember Your preferences

  • Advertising cookies and pixels that help Us and our partners deliver, limit the frequency of, and measure ads, and build audience segments

You can set Your browser to refuse or delete cookies. If You block cookies, some parts of the Website may not work properly. See Section 8 for more ways to opt out of Targeted Advertising.

6. How We Share Information

We may disclose Personal Data to:

  • Others with Your consent or at Your direction

Sale or sharing for Targeted Advertising. Some state privacy laws, such as the California Consumer Privacy Act (CCPA), may treat certain disclosures of Advertising Identifiers and related data to advertising partners as a “sale” of personal information or “sharing” for cross-context behavioral advertising, or as processing for Targeted Advertising. In the past 12 months, We may have disclosed identifiers, internet or other electronic network activity information, approximate geolocation, and inferences (interest segments) to advertising partners for these purposes. You can opt out as described in Section 8. We do not knowingly sell or share the personal information of consumers under 16 years of age.

7. Your Privacy Rights

Depending on where You live (including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon and other U.S. states with consumer privacy laws), You may have the right to:

  • Know and access the personal information We have collected about You, including the categories of sources, purposes and recipients

  • Correct inaccurate personal information

  • Delete personal information We have collected about You

  • Obtain a copy of Your personal information in a portable format

  • Opt out of the sale of Your personal information, sharing for cross-context behavioral advertising, Targeted Advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects

  • Limit the use of sensitive personal information (as noted above, We do not use sensitive personal information to target advertising)

  • Appeal a decision We make about Your request

We will not discriminate against You for exercising any of these rights.

How to submit a request. Email hello@digitalculture.group with the subject line “Privacy Request” and tell Us which right You want to exercise and the state You live in. To help Us locate data associated with Your browser or device, You may include the Advertising Identifier for that device.

Verification. For requests to know, access, correct or delete, We will take reasonable steps to verify Your identity before responding. Because much of the advertising data We process is pseudonymous, We may not be able to link it to You by name or email alone.

Authorized agents. You may use an authorized agent to submit a request on Your behalf. We may ask the agent for proof of authorization and may ask You to verify Your identity directly.

Appeals. If We decline Your request, You may appeal by replying to our response with the subject line “Privacy Request Appeal.” We will respond within the time required by law. If You are not satisfied with the outcome, You may contact Your state Attorney General.

We will respond to requests within the time frames required by applicable law (generally 45 days, which may be extended where permitted).

8. Your Privacy Choices and How to Opt Out of Targeted Advertising

You can opt out of the sale or sharing of Your personal information and of Targeted Advertising in the following ways:

  • Email Us: Send a request to hello@digitalculture.group with the subject line “Do Not Sell or Share My Personal Information.” Include the Advertising Identifier for Your device if You would like Us to apply the opt-out to advertising data associated with that device.

  • Global Privacy Control (GPC): We treat a GPC signal sent by Your browser as a valid request to opt out of the sale or sharing of personal information for that browser, where required by law.

  • Browser settings: You can block or delete cookies in Your browser settings. Opt-outs based on cookies apply only to the browser and device You use, and may stop working if You clear Your cookies.

  • Mobile devices: You can limit ad tracking or reset Your advertising ID in Your device settings (for example, “Allow Apps to Request to Track” on iOS or “Delete advertising ID” on Android).

  • Connected TV devices: You can limit ad tracking or reset the advertising identifier in Your TV or streaming device’s privacy settings.

  • Industry tools: You can also use industry opt-out tools such as the Digital Advertising Alliance’s WebChoices tool (optout.aboutads.info) and AppChoices app, and the Network Advertising Initiative’s opt-out page (optout.networkadvertising.org), to opt out of interest-based ads from participating companies.

Please note that opting out does not mean You will stop seeing ads. You may still see ads that are not based on Your interests or activity.

Marketing emails. You can unsubscribe from our marketing emails at any time by using the unsubscribe link in any email or by contacting Us.

9. Data Retention

We keep Personal Data only as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide our Services, comply with legal, tax and accounting obligations, resolve disputes and enforce our agreements. Advertising data is retained only as long as needed to deliver, measure and report on campaigns and to maintain our audience segments, after which it is deleted or de-identified.

10. Data Security

We use reasonable administrative, technical and physical safeguards designed to protect Personal Data, including access controls that limit data access to authorized personnel, encryption in transit, and secure cloud infrastructure. No method of transmission over the internet or electronic storage is completely secure, so We cannot guarantee absolute security.

11. Our Role as a Service Provider

When We process first-party data that a client provides to Us to run that client’s campaigns, We act as a service provider (or processor) to that client. In those cases, We process the data only on the client’s instructions and under our contract with them, and the client’s privacy notice governs its collection. If You have questions about how a specific brand uses Your data, please contact that brand directly.

12. Children’s Privacy

Our Services are not directed to children. We do not knowingly collect Personal Data from children under 13, and We do not knowingly target advertising to children under 13 or use the Personal Data of consumers under 16 for Targeted Advertising. If You believe We have collected Personal Data from a child, please contact Us and We will take steps to delete it.

13. International Transfers

We are based in the United States, and Personal Data may be processed in the United States and in other countries where our Service Providers or partners are located. Data protection laws in those countries may differ from those where You live. Where required, We take steps designed to ensure that transferred data receives appropriate protection.

14. Links to Other Websites

Our Website may contain links to websites and services We do not operate. We are not responsible for the privacy practices of those third parties, and We encourage You to review their privacy policies.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When We do, We will update the “Last updated” date at the top of this page. If We make material changes, We will provide notice as required by law, such as by posting a notice on our Website or emailing You.
